零售业开放式保护是在全面开放的大环境下,将国际法引入到国内法层面,从社会、安全、消费者权益等方面实施对零售业的局部性保护.在全面开放和全球贸易保护主义的双重背景下,我们仍有必要对零售业进行开放式保护.本文从《服务贸易总协定》(简称GATS)视角出发,运用GATS的灵活性条款及其给与发展中国家的优惠安排,提出提高市场准入隐性壁垒、国内管制、政府采购政策、补贴政策、紧急保障措施等零售业开放式保护路径.

Opening protection of the retail industry is partial protection on retailing from the aspects of society, safety and consumers' rights by introducing international laws to domestic laws and regulations under the circumstances of full opening. It is necessary for us to take opening protection on China’s retail industry in the background of full opening and global trade protectionism. Form the view of the General Agreement on Trade in Services (GATS), this paper uses the flexible terms of GATS and its preferential arrangements given to developing countries, and proposes that opening protection of China's retail industry can be ef ected by invisible barriers to market access, domestic regulation, government procurement policies, subsidies, and emergency safeguard measures.
