法官释明权是民事诉讼中的重要制度.我国现行《民事诉讼法》并未对法官释明权制度作出明确规定,仅在一些司法解释中出现了个别类似规定,且这些粗线条的规定对释明权的主体、范围、行使时间等均未加以明确.建立我国完善的法官释明权制度,应当对释明权的适用范围、行使时间、行使方式、后果救济等方面进行规范,确保司法实践中法官的权力行使有法可依.

@@@@The judge's elucidatory authority is an important system in civil procedure .It has not been clearly defined in China's current civil procedure law . Only some similar provisions appeared in judicial interpretations , and they don't make clear the main body , scope , perform time of the judge's elucidatory authority .The structure of the judge's elucidatory authority system should provide the scope , perform time ,perform mode , consequences of relief to ensure there are laws for the judge to abide by .
