通过对新会法院涉农案件的实证分析,农村基层民主存在村民选举权虚化、村干部滥用权力损害公共权益、村干部经济犯罪频发等现象.民主选举缺乏教育和引导、村民自治的管理机制流于形式、民主监督缺乏完善机制、法律救济途径不完善,是造成困境的制度原因.须从立法、制度创新、部门联动等方面提出相应的对策.
通過對新會法院涉農案件的實證分析,農村基層民主存在村民選舉權虛化、村榦部濫用權力損害公共權益、村榦部經濟犯罪頻髮等現象.民主選舉缺乏教育和引導、村民自治的管理機製流于形式、民主鑑督缺乏完善機製、法律救濟途徑不完善,是造成睏境的製度原因.鬚從立法、製度創新、部門聯動等方麵提齣相應的對策.

@@@@By empirically analyzing Xinhui court’s judicial cases which are concerned with peasants, the phenomenon, such as the affectation of democratic election, village official abusing power to harm the public interesting and village official committing economic crime, often happen in basic democracy of rural area. The institutional causes of the dilemma include the vacancy of education and guidance for democratic election, the management mechanism of autonomy of villagers becoming a mere formality, the imperfect mechanism of democratic supervisor, and poor way of legal remedy. It must make countermeasures from legislation, institutional innovation, and associated action of departments.
