随着时间消逝的只是某种法本质的观点,而法本质本身是不会消亡的.时至今日,对法本质的探讨尚无统一定论.以生存论的视角来阐释法的本质或许不能给予最终定论,但应当能够提供一个出发点.这一生存论具体体现在人类的日常生活中,在法律这一事质领域,则是指司法活动本身.因此,确切的说,探寻的新视角包括两个方面:日常生活和司法活动.

The perspective of survival theory to explain the na?ture of the law may not be able to give a final conclusion, but should be able to provide a starting point. This sur?vival theory is embodied in human daily life, and in this matter of the legal quality of the field, it refers to judicial activities. Therefore, precisely speaking, exploring a new perspective includes two aspects: the daily life and judi?cial activities.
