矿业权价款本质上是为维护市场经济条件下勘查主体出资勘查的权益.矿业权价款属于级差地租(Ⅱ),归矿业权人所有,必须明确:(1)矿业权价款虽分探矿权价款和采矿权价款,但实质上体现的是探矿权价值;(2)探矿权价款归属于探矿出资人和勘查者共同所有.导致当前矿业权价款的法定要件已被全面突破,矿业权价款的经济属性和权益归属已被严重扭曲的症结原因主要是价款属性误释论、权益维护论、使用资源升值论、资源价值论、以矿生财论五种错误认识.应加强理论研究、完善行政法规、完善资源税费政策、健全宏观调控体系,为矿业权出让市场健康发展提供理论支撑.

This paper argues that we must give a clear definition to these two issues:although the money paid for mineral rights include the cost of exploration rights and the cost of mining rights, it essentially reflects the exploration right value. And the cost of exploration rights is owned by both prospecting contributor and explorer. This paper points out the reasons why the legal elements of the current price of mining rights have been comprehensively broken through; and the economic attribute and rights belongingness have been highly distorted. These are: misinterpretation of price attributes, maintenance of rights and interests, appreciation of resources use, resources value and money-making based on mining. On account of this, this paper suggests that we must strengthen the theory study, perfect administration law and resources tax policy, improve the macro-economic control system, so that we can provide theoretical support for sound development of the transfer market of mining rights.
