国家于2009年制定了《食品安全法》,但对食品生产加工小作坊(以下简称食品小作坊)和食品摊贩的管理工作却没有作具体规定,而是授权省级人大常委会制定管理办法.目前,食品小作坊和食品摊贩管理法治化进程中还存在不少问题,亟需解决.因此,有必要从传统、秩序与安全的多元化价值取向出发,在行政法的视野下,对食品小作坊和食品摊贩管理法治化进行研讨.

@@@@China laid down the Food Safety Law of the People’s Republic of China (hereinafter referred to as Food Safety Law) in 2009. However, there is no specific provision about the small food production and processing workshop (hereinafter referred to as small food workshop) management and food vendor management. It is authorized to the Provincial People's Congress Standing Committee to formulate related management measures. At present, there exist not a few problems desperately need solution in the legalization process of the management. Therefore, according to the own working practice, under the administrative law perspective, the writer tries to offer some suggestions for the legalization of small food workshops management and food vendor management from diversified value orientations of people's livelihood, tradition, order and security.
