民族民俗文物与非物质文化遗产相互联系,在“非遗”的立法保护过程中,应注意它的载体——民族民俗文物的法律保护.为此,建议将民族民俗文物的立法保护纳入法制化建设轨道,及时进行民族民俗文物大普查,紧抓“非遗”立法中民族民俗文物应保护的机遇,改变民族民俗文物法律保障体系真空,修订和完善《非物质文化遗产保护法》,在条件趋于成熟时制定独立的《民族民俗文物保护法》或《民族民俗文物保护条例》,以加强非物质文化遗产立法中的民族民俗文物法律保护.
