现阶段我国已经建立了基本的非法证据排除规则制度体系，但由于缺乏详细的配套规则，在一些具体问题的理解、运用上，司法机关之间、司法机关与当事人之间容易产生认识上的分歧，影响法律的正确适用，给审查起诉阶段的检察办案人员带来极大困扰。对非法证据排除规则的细化与完善，不仅有助于检察人员正确运用程序设计，确保案件质量，更有利于充分发挥规则效用，实现惩治犯罪与保护人权的有机统一。

The basic exclusionary rule of illegal evidence has been established in China. However due to lack of detailed corresponding regulations, the disputes come into being in the understanding and use of some spe-cific problems between the judicial organs, as well as between organs and parties, which influence the correct application of the law, and brings great distress to procuratorial personnel handling the case at the stage of re-view and prosecution. The improvement and refinement of exclusionary rule of illegal evidence not only can help prosecutors to apply of the procedure design correctly, and to ensure the quality of case, but also it is more conducive to give full play to utilize the implementation of rules, to achieve the organic unity between the punishment of crime and protection of human rights.
