2013年《民事诉讼事法》第55条规定了公益诉讼，可是，从诉讼标的的角度，“公共利益”在实体法中的阙如成为公益诉讼正当性的一种阻遏，那么，在以权利而非利益方可启动诉讼的前提下，只有对“公共利益”进行权利化描述才是根本出路。在求证出公益诉讼的诉讼标的之后，诉讼担当是成为检察机关介入公益诉讼的最佳理论依据，但是，检察机关承接的只能是公益诉讼形式上的权利，而实体权利仍归真正权利人。

Article 55 of Civil Procedure Law in 2013 provides the matter in public interest litigation. However, from the perspective of the object of litigation, the public interest is taken as a repressor of the legitimacy of the public interest litigation. Then under the premise that the right not the interest can start proceedings, only that the public interest is depicted as rights is the fundamental way. After proving the object matter of the public interest litigation, the litigation act can be the best theoretical basis for prosecution involved in the public in-terest litigation, however, the prosecution only undertakes the rights in form of public interest, and substantive rights still belong to the real obligee.
