比较广告已被广泛用于商业宣传、企业竞争,但是我国关于比较广告的法律规制仍然存在立法不完善、实践规范性不强、不确定因素众多的缺陷,这使得市场经济中关于比较广告的认定、规范、法律纠纷的解决成为难题,严重扰乱竞争秩序、损害消费者利益。针对这种我国比较广告所造成的不利现象,完善我国比较广告之立法,不仅应从立法理念重构入手,而且应进行规制制度之再构。
比較廣告已被廣汎用于商業宣傳、企業競爭,但是我國關于比較廣告的法律規製仍然存在立法不完善、實踐規範性不彊、不確定因素衆多的缺陷,這使得市場經濟中關于比較廣告的認定、規範、法律糾紛的解決成為難題,嚴重擾亂競爭秩序、損害消費者利益。針對這種我國比較廣告所造成的不利現象,完善我國比較廣告之立法,不僅應從立法理唸重構入手,而且應進行規製製度之再構。
비교엄고이피엄범용우상업선전、기업경쟁,단시아국관우비교엄고적법률규제잉연존재입법불완선、실천규범성불강、불학정인소음다적결함,저사득시장경제중관우비교엄고적인정、규범、법률규분적해결성위난제,엄중우란경쟁질서、손해소비자이익。침대저충아국비교엄고소조성적불리현상,완선아국비교엄고지입법,불부응종입법이념중구입수,이차응진행규제제도지재구。
Comparative advertising has been widely used in commercial advertising and business competition,but legislation on comparative advertising still with such defects as inadequate regulation, weak practice, uncertainties factors. All these cause the difficulties in comparative advertising definition, regulation and dispute resolution, then seriously disrupted the order of competition and consumers’ interests. In order to change this adverse phenomenon caused by China’s comparative advertising and improve the present legal system, we should not only deal with the concept of reconstruction, but also regulate the system of regulation comparative law again.
