《中华人民共和国精神卫生法》第三十条第二款中，对精神障碍患者实施住院治疗危险性标准，这是以法律的形式在我国第一次明确了精神障碍患者强制住院治疗的危险性标准。但是该条文在实施过程中尚有诸多问题：严重精神障碍与危险性之间的因果关系，危险性的判定机构，构成危险性的行为方式，危险行为的客体，危险发生的可能性和严重程度等。针对这些问题，本文提出了相应的对策，以期有助于危险性标准在实践中的适用。

Mental Health Law of the People's Republic of China has established dangerous standard of civil commitment in Paragraph 2 of Arti-cle 30, which is the first dangerous standard for the mentally disturbed in China.However, there are several problems to be solved in the imple-mentation, including that whether there must be causation between serious mental disorder and dangerousness, who decides the dangers, whether dangerousness encompasses omissions, what the objects of dangerous behaviors include, and how it possible and how serious the anticipated harm is for civil commitment to be justified.To address these problems, the article puts forward corresponding proposals which are expected to contrib-ute to the application of the dangerous standard in practice.
