废弃矿区带来的水环境破坏与污染、土壤流失或者土壤污染、影响生物多样性、地貌景观等环境问题不容忽视，应采取有效的防治措施予以应对，以便有效均衡和协调废弃矿区的经济、环境和安全之间的关系。完善的废弃矿区闭矿立法是有效防治废弃矿区环境问题的前提。国外废弃矿区闭矿立法遵循污染者负担及例外原则分配责任；实施闭矿计划进行源头控制；实行闭矿分级治理制度确保重点区域优先治理；设立闭矿专项基金制度保障土地复垦。我国应借鉴其经验，完善污染者负担及例外原则，确立闭矿计划制度，设立闭矿专项基金制度；实行闭矿分级治理制度等。

Destruction and pollution of water environment, soil erosion and soil pollution caused by abandoned mines have an impact on biodiversity and geomorphologic landscape. Therefore we must pay more attention to these environmental issues; and adopt effective control measures. Only then can we effectively balance and coordinate the relationship between the economy, environment and security of abandoned mining zone. This paper points out that the sound legislation for closing abandoned mines is the base for effectively controlling the environmental problems. In foreign countries, they make the legislation for closing abandoned mines according to polluter pays and exceptions principle. They work out closing plan to control the pollution at the source. At the same time, in order to give priority harness of the key areas, they carry out the system of different levels holding different responsibilities, establish special fund for closing mines so as to ensure land reclamation. All of these foreign experiences are good for us, so we must use them for reference.
