由于规划本质界定不合理、政府管理层权力过于集中、规划组织结构不合理、土地分区缺乏独立性、个体权益保障水平低等深层次原因,当前我国土地利用规划存在的主要问题有:(1)规划权限集中,微观设计缺位;(2)规划效力滞后,管制效果薄弱;(3)规划分类概略,衔接模式粗放;(4)目标分解粗略,实施措施缺乏;(5)分区模式不当,管制规则不足;(6)公共参与缺失,权益保障不力。对我国土地利用规划改革的建议:(1)深化简政放权,加强部门协调;(2)改革土地分类,促进城乡一体;(3)优化土地分区,实现定量管制;(4)立法公共参与,保障主体权益。

There are some underlying reasons such as unreasonable essence of planning, too centralized power held over by the governmental administration, unreasonable planning structure, land zoning without independence, and low level of protection of individual rights and interests in making land use planning. This paper focuses on the main problems that China faces in making land use planning. These problems are as follows: ifrst, the authority for planning is centralized, and micro-design is absent. Second, the effect of planning is lag, and control effect is weak. Third, the classiifcation of planning is indistinct, and connection model is extensive. Fourth, target decomposition is rough, lacking of implementing measures. Fifth, partitioning mode is improper, and short of control rules. Sixth, opportunity from the public participation is absence, and protection of rights and interests is poor. On account of this, this paper proposes that we should simplify administration and transfer power to a lower level, and strengthen coordination of the departments. Furthermore, we should reform land classiifcation and promote the integration of urban and rural areas, optimize land zoning and realize quantitative control. Public should participate in work of legislation so as to guarantee the rights and interests of the principal part.
