在法国，祖父母对孙子女的探望权最早是通过判例形成的，在长期的司法实践中，探望权制度不断获得发展。为了保护孙子女的利益，法国对祖父母探望权设置了一定的限制理由，并且通过立法将孙子女作为探望权主体，为了确保实现探望权，对于拒绝探望请求者可以给予刑事处罚。目前，在我国如何完善探望权制度是个热点问题，法国的司法实践和立法经验值得我国借鉴。

In France, grandparent’s visitation is formed through judicial case, in the long-term judicial practice, the visitation right system perfect.
