中国法治建设在“三重转变”、人治与法治、传统与现代的复杂关系中,虽要面对破旧立新的复杂性,但也容易形成未来发展趋势的规划。世界性的可持续发展的社会变革运动,为中国的政治、经济改革指明了方向,也为中国法治建设拨开了迷雾。从宏观到微观,中国在社会可持续发展过程中进行了法治变革,但中国法治建设在社会可持续发展过程中也面临着中国固有的人治传统的影响和西方化的法治实践的挑战。基于人的全面发展的考虑,中国法治建设需要构建符合中国国情的法治路径,形成以健全公平的利益分配机制、健全社会保障法律体系、完善社会权利救济途径为路径的促进社会和谐的法律体系。
中國法治建設在“三重轉變”、人治與法治、傳統與現代的複雜關繫中,雖要麵對破舊立新的複雜性,但也容易形成未來髮展趨勢的規劃。世界性的可持續髮展的社會變革運動,為中國的政治、經濟改革指明瞭方嚮,也為中國法治建設撥開瞭迷霧。從宏觀到微觀,中國在社會可持續髮展過程中進行瞭法治變革,但中國法治建設在社會可持續髮展過程中也麵臨著中國固有的人治傳統的影響和西方化的法治實踐的挑戰。基于人的全麵髮展的攷慮,中國法治建設需要構建符閤中國國情的法治路徑,形成以健全公平的利益分配機製、健全社會保障法律體繫、完善社會權利救濟途徑為路徑的促進社會和諧的法律體繫。

Chinese construction of law faces the complexity of reform as well as forming the future development trend in such complex relationship as triple transformation, the rule of man and the rule of law, and tradition and modernity.Social change movement for worldwide sustainable development just points out the direction for political and economic reform and the construction of Chinese rule.From macro to micro level, China carries out the rule change in the process of sustainable development of society, but the construction of Chinese rule faces the inherent traditions of Chinese rule of man and the challenge of Western law practice. Based on the all-round development of people, the construction need build the path of rule in line with Chinese national conditions to form a sound mechanism for equitable distribution of benefits, improving the social security legal system, the social rights remedies for promoting social harmony legal system.
