The criteria for the negative listing sectors is the key issue in the further open up for free trade zone in China. Bhagwati’s Sub-Optimality theory is a suitable theory for China to justify its negative list and choosing its listing industry. We should put the industry which has the distortion come from externality or growth potential and use the inconformity measures to negative list with special treatment. We also should learn from the negative list sectors of other countries and pursuit a prudence and mutual opening up strategy. Furthermore, we should dynamic amendment the listing and stimulus the competitiveness of listing sectors and expanding the opening up level.
