专利法第三次修改对保密审查的规定做出调整，以促进多元主体下重大专利的保密，但实施过程中出现的审查效率低、缺乏补偿措施及制约科研发展等问题使向外申请保密审查制度在某种程度上偏离原先设定的功能，影响了专利申请人的合理利益和国内外先进技术的合作研发。为实现国家安全、专利权人合理利益及技术引进间的平衡，我国应借鉴国外的先进经验，简化审查程序，建立快速通道，提供救济途径，充分发挥保密审查在科技创新中的积极作用。

The third revision of patent law stipulated provisions on confidentiality examination for international patent appli-cations to better regulate major inventions under multiple subjects and safeguard national security. However,there are some problems in the process of implementation,such as low efficiency,lack of compensation measures and restricting environ-ment for scientific research,which have made confidentiality examination system deviate from original designed functions and affected patent applicant's reasonable interests and domestic and international R&D cooperation. To balance national se-curity,technology innovation and reasonable interests of patent applicants,China’s patent office should draw on foreign practical experience,simplify the procedure,establish fast-track and provide relief ways to make the confidentiality exam-ination play a positive role in technological innovation.
