基于制度经济学制度变迁理论,探讨了中国土地征收征用现行立法同转型时期经济发展之间的互动与博弈。回顾土地征收的发展历程,可以看出土地征收制度的构建、初始发展主要借助于国家立法,是一种自上而下的强制性变迁路径。目前国家“允许农村集体经营性建设用地出让、租赁、入股,实行与国有土地同等入市流转、同权同价”则是以市场经济为导向、社会规则自我演绎自下而上推动的诱致性变迁获得了政策层面的首肯,也是农村集体经济组织、乡镇地方政府与农民共同推动的制度创新需求。这种诱致性制度变迁以市场经济的内在需求打破了原有的制度均衡,必将推动新的制度均衡建立。
基于製度經濟學製度變遷理論,探討瞭中國土地徵收徵用現行立法同轉型時期經濟髮展之間的互動與博弈。迴顧土地徵收的髮展歷程,可以看齣土地徵收製度的構建、初始髮展主要藉助于國傢立法,是一種自上而下的彊製性變遷路徑。目前國傢“允許農村集體經營性建設用地齣讓、租賃、入股,實行與國有土地同等入市流轉、同權同價”則是以市場經濟為導嚮、社會規則自我縯繹自下而上推動的誘緻性變遷穫得瞭政策層麵的首肯,也是農村集體經濟組織、鄉鎮地方政府與農民共同推動的製度創新需求。這種誘緻性製度變遷以市場經濟的內在需求打破瞭原有的製度均衡,必將推動新的製度均衡建立。

Based on the theory of institutional economics,explores the Chinese land expropriation and requisition to interact with the game between economic development of existing legislation with the transition period.Review the development process of the land expropriation,we can see that the land expropriation system construction,the initial development mainly depend on national legislation,is a top -down mandatory change path.At present the country "allows the management of rural collective construction land transfer,lease,and the implementation of state -owned land equal shares,market circula-tion,Tong Quan price"is the market economy oriented,social rules self interpretation of bottom -up driven induced change won the policy level approval,system innovation is the demand of the rural collective economic organizations,vil-lages and towns local governments and farmers to promote the.The induced institutional changes to the internal needs of market economy has broken the balance of the original system,will promote the establishment of new institutional equilib-rium.
