随着社会的发展和互联网技术应用的普遍化，“人肉搜索”这一现象开始进入人们的视野。“人肉搜索”作为网络信息时代的产物，在宣扬惩恶扬善的社会正义的同时，也屡屡出现对公民权利的侵犯。网络世界虽然是虚拟的，但产生的影响却是现实的，因此对产生危害的“人肉搜索”进行规制已成为必要。本文通过对“人肉搜索”现象进行分析，得出对“人肉搜索”的痛恨并不能成为其入刑的理由，“人肉搜索”入刑涉及到价值判断、合理性、可行性等众多问题，笔者认为目前“人肉搜索”入刑仍欠缺合理性，应通过其他方式对其进行规制。

With the development of social and generalization of Internet applications,cyber manhunt came into our view.cyber manhunt,as a product of the information age,is promoting good and punishiing evil.But it also frequently appeared in civil rights violations.Although the network is a virtual world,but the impact is real.And regulating cyber manhunt t has become necessary.Based on analysis on the cyber manhunt phenomenon,the author drew the conclusion that although pepople hate cy-ber manhunt but it can not be a reason for mposing Criminal Law on it.And imposing Criminal Law on cyber manhunt involves many issues of value judgment,rationality and feasibility.The author thinks that imposing Criminal Law oncyber manhunt is still lack rationality and we should use other means to regulate it.
