环境问题和环境社会关系为环境法接受外部性理论提供了前提和基础。外部性理论在我国环境管理体制、环境法律原则和法律制度的构建中得到广泛应用，但我国对外部性理论的应用存在“应用”失衡和“规制”失衡的问题。其深层原因是对于环境问题的主因分析和外部性的解决方法，经济学和环境法学具有不同的思量和价值取向。我们应该改变对外部性理论的单向度应用，以正外部性理论指导环境法的“正向构建”，积极应对“政府失灵”，使环境法的功能从“利益限制”进化为“利益增进”，在“损害担责”、“受益补偿”的基础上增设“养护受益”、“恢复受偿”原则，创设更多的利益增进型法律规范。

Environmental issues and social relations provide premise and foundation for the externality theory into the field of environmental law.Externality theory is widely used in the management system,basic legal principles and basic legal systems of environmental law.However,there is imbalance in the application of externality theory:application imbalance and regulation imbalance.The deep-seated reason is that?eco-nomics and environmental?law have different value orientation in the analysis of the causes of environmental problems and solutions of the externality.We should change the one-dimensional application of the externali-ty theory,highlight the value of positive externality theory to promote the “positive construction”of environ-mental law and respond to the “government failure”actively,make the function of environmental law from“interest limited”evolve into “interest enhanced”,create principle of “those who maintain benefit”and‘those who restore accept compensation”on the basis of “those who damage bear the responsibility”and“those who benefit compensate”and more “interest enhanced”legal norms.
