现代物流业是综和运输、仓储、货代、信息的复合型产业，是支撑国民经济发展的基础性和战略性产业。2014年12月国务院印发我国《物流业发展中长期规划(2014年-2020年)》，规划中指出我国物流产业规模近年来逐步增长，但同时存在政策法规体系不够完善，市场秩序不够规范现状。我国物流业至今没有一部统一的立法，体现出法制的缺陷与不足。根据对我国现有物流法研究文献的甄别研究，发现研究重点集中在呼吁立法和相关立法建议的层面，针对物流法研究的成果泛善可陈，尤其是关于物流法实证研究的运用。基于以上问题首先对我国物流法本土化研究的价值及意义进行探讨，主要从问题意识的理论起点和经验主义的实践起点入手分析。其次对实证研究的具体路径在操作层面的几个环节进行论述，分别从实证研究的经验(司法经验)、研究对象和受众三个方面阐释。最后对物流法实证研究的个案进行评析。
