刑罚目的与量刑基准关系密切，量刑时必须考虑预防犯罪的目的。积极的一般预防论在目的刑论中占据着重要地位，它试图从提升公民的法律信仰、发扬公众的守法精神、强化一般人的法律忠诚信念的角度正面论证一般预防的积极效果。但是，它所提倡的量刑基准可能不利于实现预防效果，无助于提供清晰的刑罚限度，导致处罚的扩大化和严厉化。通过反思积极的一般预防论中量刑基准的缺陷，可以给我国刑法理论带来深刻的启示。

형벌목적여양형기준관계밀절，양형시필수고필예방범죄적목적。적겁적일반예방론재목적형론중점거착중요지위，타시도종제승공민적법률신앙、발양공음적수법정신、강화일반인적법률충성신념적각도정면론증일반예방적적겁효과。단시，타소제창적양형기준가능불리우실현예방효과，무조우제공청석적형벌한도，도치처벌적확대화화엄려화。통과반사적겁적일반예방론중양형기준적결함，가이급아국형법이론대래심각적계시。
The criminal purpose has a close relationship with sentencing criterion, so the purpose of preventing the offences needs to be considered in sentencing. The theory of positive general prevention occupies an important position in the theory of punishment ,attempting demonstrate the positive effects of general prevention in enhancing citizens’ legal faith, developing public spirit of complying with the law and strengthening the majority’s convictions of law loyalty. However, the sentencing criterion advocated by the theory of positive general prevention may harm attaining preventive effects, may be helpless to provide clear penal limits and may cause expansion as well as severity of punishment. Reflecting the defects of the sentencing criterion will be able to bring some profound revelations to our criminal science.
