中信信托、北京信托参与的农村土地流转信托模式相比传统的土地流转模式具有一定的金融创新意义。该信托属于商业信托，信托财产是承包土地的经营权，信托期限受到农地承包经营权期限的限制，土地流向上限制为从事农业生产经营的组织和个人。这种信托模式有利于土地的集中经营，有利于农民权益的保护，有利于农业产业升级。目前，这种金融创新并不存在重大法律障碍，但是由于相关规定的不完善，在土地流转安全等方面存在一定法律风险。因此，未来应该出台相应法律政策，对于委托人、受托人等主体的资格、信托登记法律制度等问题进行专门规定，推动我国农地流转信托的发展。

Compared to traditional land circulation model,there is practical significance,as finance innovation,in the new trust model.The trust belongs to commercial trust.The trust prop-erty is the management right of the rural land.Its period is no longer than the period of the con-tractual right of land.And the land shall be transferred to the organizations and individuals en-gaged in agriculture.This trust contributes to land concentration operations, the protection of farmer’ s rights and the upgrade of the agriculture.From the point of law,the trust is legal,but still facing some legal risks.Therefore,a new law shall be enacted to stipulate the issues of trus-tor,trustee and the registration.
