在社会转型期，软法更容易适应迅速变化的社会实际。尤其是在繁杂的行政事务中，软法可以发挥更加积极的作用。我们需要挖掘软法在反对暴力恐怖活动、保障民族自治中的潜力，认真研究软法之治同协商民主相互促进、共同发展的制度。在推行软法之治时，应该注意坚持软硬兼施，绝不放松硬法的权威和规范，同时，防止政府俘获的风险，这要特别注意完善和规范作为软法的重要形式的党规党法的制定、实施、监督程序。

During the period of social transformation,soft law is easier to adapt to the rapid change of social reality.Espe-cially in the complicated administrative affairs,soft law can play a more positive role.We need to tap the potential of soft law in combating violent terrorist activities and ensuring national autonomy.We should also study how to make the governance of soft law and deliberative democracy become mutual and different systems.In implementing the governance of soft law,we should pay attention to insisting on use of both hard and soft tactics and never relax the authority and norms of hard law,at the same time,we must prevent the risk of government capture.Special attention should be paid to improving and standardizing the for-mulation,implementation and supervision procedure of the rules and regulations of our Party as an important form of soft law.
