技术侦查手段是在适应几类案件层出不穷、侦查难度大和犯罪人反侦意识强等严峻形势下不断扩大运用的。但是由于技术侦查手段有其固有的侵犯他人隐私权和宪法赋予公民人身自由权的特点，故技术侦查手段的法制化，对于人身权利保障有着十分重要的理论和实践意义。基于我国技术侦查措施法治化的轨迹和演变历程，着重分析其目前的困境，提出了我国技术侦查法治化的三条路径选择，以期达到惩罚犯罪与保障自由的双重目的。

Technical measures of investigation are widening range of application to adapt to the stern fact, which includes fre-quenter emergence of diverse law cases, increased difficulties in investigation and strengthened criminal’ s awareness of anti-detect. However, as technical measures of investigation embody some inherent characteristics such as infringement of privacy and other rights of personal liberty which enjoy constitutional protection, encaging it in the rule of law has a very important theoretical and practical significance. Based on the evolution of our country’ s technical measures of investigation governed by law, this paper put emphasis on analyzing predicament in the process of bring technical investigation under the rule of law. From the tough situation, this paper put forward three roads of legalizing the technical investigation to meet the goals both in crime punishment and freedom guarantee.
