《医疗事故处理条例》确定了医学会鉴定医疗事故的地位，而《侵权责任法》出台后，医疗纠纷民事赔偿中没有了医疗事故的概念，医疗损害责任鉴定由谁承担在实践中存在争议。通过对目前国内现行医疗事故技术鉴定和司法鉴定两种鉴定模式的利弊比较，进一步提出建立统一医疗损害技术鉴定制度的建议。

Medical malpractice handling rule has appointed Chinese Medical Association as the main body on medical malpractice identification. But there was no concept of medical malpractice in medical dispute civil compensation when Tor Liability Law implemented. Who have the qualifications to identify medical damage has contentious in juridical practice. After comparing the advantages and disadvantages of medical malpractice technical identification and juridical identification, suggestions on establishing all recognized medical damage technical identification system is discussed.
