孕育于实践中的基础设施收益权质押作为一种创新的融资担保方式，对于解决实践中基础设施建设融资难的问题发挥了重要作用。然而在实践中蓬勃发展的基础设施收益权质押却面临着法律依据不足之困境。鉴于上述背景，有必要重新梳理与检讨我国现行立法，从民法与经济法二元视角为进路展开论证与架构，以期对我国基础设施收益权质押制度的完善与发展能有所裨益。

Bred in the practice of the pledge of receivable right of the infrastructure as an innovative financing way, played an im-portant role in solving the infrastructure construction financing difficult problem. However, the vigorous development in the practice of the pledge of receivable right of the infrastructure is faced with the dilemma of lack of legal basis. In view of the above background, it is necessary to review the current legislation of our country, from the perspective of the civil law and economic law, to carry out the demonstration and construction, in order to benefit the improvement and development of the system of the pledge of receivable right of the infrastructure.
