医患关系愈发成为社会焦点问题。医患关系的法律性质在法学理论界颇有争议。主要有这几种学说，如民事法律关系说、消费法律关系说、行政法律关系说、社会保障法律关系说。这些学说无疑是要解决医患法律关系在司法实践中的适用问题。本文拟在讨论各种学说的基础上，指出对卫生单独立法，构建独立医事法律体系的意义。

Doctor-patient relationship increasingly become a social focus. The legal nature of the doctor-patient relationship in legal theory is quite controversial. There are several theory such as civil legal relations theory, consumer legal relationship theory, administrative legal relationship theory and social security law relationship theory. The theory undoubtedly should solve problems of the application of the legal relationship between doctors and patients in the judicial practice. This article intends to indicate the significance of separating legislation on health and building independent medical legal system.
