工业文明带来了经济的繁荣，也引发了日益严重的生态环境问题。民间环保组织雨后春笋般地出现，是应对生态环境问题的现实需要，也是社会治理的基本表现，还是政府环境监管的有益补充。国内外立法上对民间环保组织的诉讼资格及其与环保行政机关关系的态度宽严不一，这与各国法律文化传统及环保政策导向有关。我国新近出台的《环境保护法》第58条对民间环保组织的诉讼资格的规定过于苛刻，对如何理顺与环境行政机关的关系付诸阙如，这对环境公益诉讼的开展极为不利，有必要对该条进行深刻探讨，并做出详细解释。

Industrial civilization brings about not only economic prosperity,but also more and more serious ecological environment problems.The springing up of grassroots ENGOs is a practical demand to deal with those problems,a basic performance of social management and a necessary supplement of government environmental regulation.Domestic and abroad legislative attitudes to the lawsuit qualification of the grassroots ENGOs and the relationship between grassroots ENGOs and environmental authorities differ:some are strict,some are loose,those different attitudes have to do with legal tradition and orientation of environmental policy.The regulation on lawsuit qualification of grassroots ENGOs in new environmental protection law article 58 is overstrict and barely touches straightening out relationships between grassroots ENGOs and environmental authorities,which is harmful to expansion of environmental public interest litigation.Therefore,it is necessary to give a profound discussion about Article 58 and promulgate detailed judicial interpretations.
