合同无效只意味着合同对当事人没有法律约束力，而不意味着不得履行，更不意味着任何公法性的后果。目前的合同无效概念无法涵盖合同绝对无效的全部情形，亦无法涵盖合同相对无效。“任何人均得主张其为无效”中的“主张”有其特定的含义。合同相对无效的类型只有“不得对抗善意第三人型”这一种，学界迄今所提及的其他类型的合同相对无效均非真正的合同相对无效。

The invalidity of contract only implies that contract exercises no legal binding force upon contract parties, not implementation of contract or bearing any public law consequences. The conception of invalid contract at present can cover neither all types of absolutely invalid contract nor relatively invalid contract. The“propose”in“Everyone proposes the invalidity of contract” has its specific implication. The relative invalidity of contract is limited to the type of“Do not run against a bona fide third party”. The relative invalidity of the other types of contract discussed in academic circle is not the real-sense relative invalidity.
