亲属拒证权无论在我国历史抑或外国历史中都占有重要的地位。其对人权的保护，对社会秩序的稳定乃至于对一国法律制度的顺利运行都具有重要的作用。虽然现行亲属拒证权制度具有合理性，但是应该在拒证的范围、主体和形式等方面加以变动和限制，从而更好地服务于当前法律体系的运行。

The relatives have the right to refuse to bear witness, which occupies an important position in history of Chi?na and foreign countries. The right has important function in the protection of human rights, stability of social order and smooth operation of legal system. Although current system of refusing to testify by relatives is rational in some de?gree, it should be restricted and changed in the aspects of refusing scope, corpus and forms, thus to better serve the movement of current legal system.
