量刑的规范化构建是确保量刑公正的法律保障。量刑活动的逻辑层次关系和对具体要素本质属性的共识是确保量刑规范化构建的理论前提。确立量刑证明的事实观、量刑刑罚幅度的价值观和量刑裁量的方法论，有助于深入探索量刑规范化的逻辑层次关系和理论体系构建。以量刑证明事实观引导量刑证据、量刑证明的规范化体系构建，排除量刑请求与量刑证明的直接关联；以价值观为指导，确立刑罚的基本单元和刑罚幅度；以量化裁判的理念确立量刑的计量方法。最后，运用系统论思想协调量刑证明、量刑刑罚和量刑裁量三者的有机统一，实现量刑公正。

Standardization of sentencing is a legal protection to ensure that sentencing is just. The logical relationship and the consensus of the essential attribute of the speciifc elements in the sentencing activity are the theoretical premise of establishing sentencing standardization. The establishment of the concept of basing on facts in sentencing proof, values which decide the punishment range in sentencing activities, and the methodology of sentencing discretion contribute to exploring the logical relationship of sentencing standardization and the establishment of its theoretical system. The concept of basing on facts guides the standardization of evidence and proof in sentencing, eliminating the direct relationship between sentencing suggestion and proof of sentencing. Guided by values, the basic unit and amplitude of sentencing is established. Sentencing methods are established on the basis of judicial quantitative discretion. In the end, system theory should be used to realize the organic unity of proof of sentencing, sentencing punishment and sentencing discretion, thus achieving justice of sentencing.
