基于一定的物质基础发展而产生的集体土地发展权是集体土地相关主体追求利益的必然产物。该权利属性合理定位的实质是对事实上土地利益分配与享有的确认与保护。无论从权利享有的主体资格、权利具备的财产价值趋向还是公权力与私权利博弈结果进行分析，游离于规划指导之公权与利益维护之私权间的集体土地发展权之私权属性都是毋庸置疑的，这是实现集体土地开发利用过程中对公权力滥用的限制和私权利主张的保障的基础。
