当场劫持人质或索取财物以及周围是否存在“近亲属般切身忧虑者”，都不是绑架罪与抢劫罪的界限，只要侵犯了第三人的自决权，就应当以绑架罪定罪。当场劫持人质的法益侵害性要比典型的绑架罪要轻，绑架罪的社会危害性还体现在其所带来的社会负面效应，即群众所产生的恐惧心理。
