临床用血对抢救患者生命、恢复患者健康作用巨大；一旦临床用血不规范，极易引发法律纠纷。在我国的临床用血实践中，存在着输血告知义务不到位，医疗文书制作不规范，错误输血，违规储存、运输血液和私自采血等容易引发法律风险的情况。对此，应从加强临床医师输血告知义务的履行、完善输血有关医疗文书的制作、加强临床用血各环节的管理、严格执行临床用血相关法律和技术规范、加强行政管理和建立输血感染保险与补偿基金等方面进行防范。

In the practice of clinical blood use in China, there are some situations easy to cause legal risks, such as blood transfusion inform obligation does not reach the desig-nated person, non-standard medical documents, blood transfusion errors, storage violation, blood transportation, and private blood collection, etc.. Accordingly, it should be regulated from the following aspects: to strengthen clinicians' inform obligation of clinical blood transfusion, to standardize medical documents, to strengthen the management of clinical blood use, to strictly enforce legal and technical specifications related to clinical blood use, to strengthen administrative management, and to establish a blood transfusion infected insurance and com-pensation fund, etc..
