生态补偿机制是生态环境保护的关键措施，是一种治理环境问题的重要政策手段。海洋作为世界上面积最大的生态环境系统，不可避免的成为生态补偿机制中重要的一块。目前，关于海洋生态补偿机制的研究多从生态学、经济学的角度出发，如何确立法律机制保障海洋的生态价值和海洋生态系统服务价值的实现存在很大的空白，这不仅导致已经展开海洋生态补偿实践的地区因缺乏法律依据而未取得良好的效果，也是对构建海洋生态补偿机制造成了障碍。
生態補償機製是生態環境保護的關鍵措施，是一種治理環境問題的重要政策手段。海洋作為世界上麵積最大的生態環境繫統，不可避免的成為生態補償機製中重要的一塊。目前，關于海洋生態補償機製的研究多從生態學、經濟學的角度齣髮，如何確立法律機製保障海洋的生態價值和海洋生態繫統服務價值的實現存在很大的空白，這不僅導緻已經展開海洋生態補償實踐的地區因缺乏法律依據而未取得良好的效果，也是對構建海洋生態補償機製造成瞭障礙。

Ecological compensation mechanism is the key of protecting the ecological environment. And it is also an important policy measure to solve environmental issues. The ocean, largest ecological environment system of the world, is the one of the most important components in the ecological compensation mechanism unavoidably. At present, the research of the ecological compensation mechanism is in the marine ecology and the economics perspective. How to establish the legal mechanism to guarantee the value of marine ecological and the value of marine ecosystem service is still lacked. It not only leads the bad effects in the area that has started the ecological compensation mechanism of the o-cean as the lack of legal basis, but also becomes the barrier for constructing the ecological compensation mechanism.
