自改革开放以来，我国人权事业不断向前迈进，在劳动者权利保障方面，国家陆续出台了《劳动法》和《劳动合同法》等相关法律法规对劳动者的休息权等相关权利进行保护。但是，由于法律法规并没有全方位地覆盖整个劳动者群体，对农民工这一特殊对象就缺乏具体的规定，导致现实中农民工的休息权未能得到充分的保障。
자개혁개방이래，아국인권사업불단향전매진，재노동자권리보장방면，국가륙속출태료《노동법》화《노동합동법》등상관법율법규대노동자적휴식권등상관권리진행보호。단시，유우법율법규병몰유전방위지복개정개노동자군체，대농민공저일특수대상취결핍구체적규정，도치현실중농민공적휴식권미능득도충분적보장。
Since the reform and opening - up,Chinaˊs human rights has been progressed continuously,and in terms of workersˊ rights protection,the government has introduced the Labor Law and the Labor Contract Law,and other relevant laws and regulations of laborer counterpoises and related rights protection. Because laws and regula-tions can not cover the entire laborer groups of all aspects,there lacks of specific provision for protecting the peas-ant - workers,a particular group,leading to the failure of complete guarantee for their rights of rest.
