本文从数据库法律保护模式变迁的角度，纵向梳理并评析了数据库的几种法律模式，并针对我国的现实国情，提出了笔者的观点：利用版权法和反不正当竞争法的现有资源；适当修订反不正当竞争法；暂缓实行特殊权利保护制度。

This paper makes a longitudinal presentation and analysis of several major legal protection modes of the database from the perspective of modes transition.Considering the realistic condition of China’s legal protec-tion of the database,the author puts forward three ways:taking available resources of Copyright Law and Anti -Un-fair Competition Law,appropriately amending the Anti -Unfair Competition Law and postponing the execution of spe-cial rights protection system.
