《联合国国际货物销售合同公约》（英文简称CISG，以下简称《公约》），是调整和规范国际货物买卖合同关系的国际公约。《公约》在联合国会议上获得通过后于1988年1月1日正式生效，到2013年7月为止，已有79个缔约国批准参与该公约，具有广泛的国际影响力和适用范围。根本违约制度是《公约》的最大亮点和最核心的制度，在国际货物销售贸易中对交易双方的权利义务产生重大影响，因此引起学者们的广泛重视。从公约起草以来，专家学者对根本违约的定义、界定标准等内容进行了激烈的争论。我国虽是国际货物贸易大国，但国内对公约的根本违约制度的研究仍不够深入，本文旨在进一步深入研究。

"United Nations Convention on the International Sale of Goods"(abbreviation CISG,hereinafter referred to as"the Convention")is to adjust the international sale of goods and the international convention on the norms."Convention"was a-dopted at the UN conference on January 1st,1988 and formally takes effect until July 2013,more than 79 countries involved in the ratification of the Convention.It has extensive international influence and scope.The mechanism of fundamental breach is the biggest highlight and it is also the core system in"Convention".It has a significant impact on the rights and obligations of parties during the transaction in the international sale of goods trade,thus causing extensive attention from scholars.Since the drafting of the Convention,experts and scholars have many heated debates on the fundamental definition of default,standard definition content.Although China is the international cargo trading nation,domestic research on fundamental breach regime of the Convention is still not deep enough.This paper aims to do the further study.
