我国新刑事诉讼法确立了未成年人附条件不起诉制度，体现了新社会防卫、刑诉谦抑、刑事和解思想。通过非犯罪化、非刑罚化的特殊预防手段，达到再社会化的目的，是我国未成年人刑事立法及刑事司法发展的重大进步。但新刑诉法仍存在适用范围过窄、缺乏控辩对抗、被害人权益保护不足、附加义务单一等问题。因此，需要从扩大适用范围、细化适用条件、完善附加义务、遵循正当程序等方面来完善这一制度。

China's new criminal procedure establishes the deferred prosecution system of the juveniles,reflec-ting the thought of new social defense,limiting criminal law and criminal reconciliation. Through such special de-fensive means as depenalization,the purpose of re-socialization is achieved,proving the great progress made by China's juvenile criminal legislation and criminal justice. However,the new criminal procedure is still not perfect. For example,its range of application is small,and it lacks the charge countermeasure. The protection for the vic-tim's right is not enough. Furthermore,the additional obligation is single. Therefore,the system should be opti-mized by enlarging the range of application,detailing the condition of application,perfecting additional obligation and following the due process.
