为了研究我国燃料电池技术专利申请情况以及专利有效性问题,借助于生存分析理论模型以及生命表方法,计算出各类专利权人各年的专利有效率S( x)以及中位数和半衰期,对我国燃料电池的发明和实用新型专利有效性规律进行探索。研究发现:国外专利权人在华燃料电池技术专利申请质量高于国内,燃料电池技术专利权人中国外的有效期限长于国内,国内企业和科研院所专利有效期限最长,高校和个人最短。因此,加强国内高校和个人燃料电池技术知识产权管理和后期成果转化显然十分必要。

In order to research the patents application of domestic fuel cell technology and status of patent in force, based on the theoretical models of survival analysis and life table method, calculated the patentee efficient S( x) each year of various types patentees as well as the median and half-life, explored the efficiency of invention and utility patents of fuel cell technology in China. Studies showed that:patent application quality of foreign patentees in China fuel cell technology is much higher;foreign patent validity period is longer than domestic validity period, and in practice the patent validity periods of domestic enterprises and research institutes were the longest, while the patent validity periods of universities and individuals were the shortest. Therefore, it is very important and urgent to strengthen the fuel cell tech-nology intellectual property management and encourage the post-patenting achievements transformation of universities and individuals.
