首先分析高校早操的重要意义，对早操的历史与现状进行探析。我国有相关的法律法规以及地方规范性文件就高校体育进行了规定，早操与大学生体育权利密切相关。就社会自治组织高校来讲，其内部的组织规范均属于软法的范畴，软法有别于传统意义上硬法（法律）的特殊性，就软法与公共治理，软法与早操制度的关系，早操的软法规范进行分析。综上，高校开展早操有一定的法律基础。

The paper first analyzes the significance of morning exercise in universities and explores the history and current situation of morning exercise.Related laws and regulations at state and local level have regulations on university sport,as exercise is closely related with college students 'sports rights.Universities are social autonomous organizations whose internal organizational norms belong to soft law.Soft law is different from the particularity of traditional hard law.The paper analyzes relationship between soft law and public governance,soft law and the system of morning exercise and regulations on morning exercises and concludes that doing morning exercises in colleges have certain legal foundations.
