著作权法是文化产业的激励法，作为其重要内容，著作权集体管理制度也发挥着比较重要的作用，甚至说著作权集体管理本身就是文化产业的一部分。近年来，面对全球化及网络化，传统的著作权集体管理已面临着挑战。文化产业比较发达的地区和国家已开始重视有关著作权集体管理制度的创新，以欧盟为代表，2014年通过了“著作权集体管理指令”①，其有关内容代表着著作权革新的思路，我国目前也在进行《著作权法》修改，而且国家又在大力发展文化产业，因此探讨欧盟的经验显得较为必要。

Copyright Law plays an important role in facilitating the cultural industries, as well as the collective management of copyright and related rights (as part of the copyright law system). CMOs can even be regarded as a part of the cultural industries. The traditional system of CMOs has been challenged by the globalization and the internet these days. Some leading states on cultural industries have emphasized the innovation of the collective management. Taking EU for example, it has just adopted a collective rights management directive in 2014 which shows us new ideas of upgrading the copyright law. As China is discussing the amending of Copyright Law and adopting the policy of developing cultural industries, it is necessary to take a salutary lesson from EU practice.
