将从分析现行刑事诉讼法第50条和第118条入手，论证我国新刑诉法实质上没有默示沉默权和明示沉默权，也没有审判沉默权和审讯沉默权。沉默权在我国刑事诉讼法中虽然若隐若现，但是我国刑事诉讼法中实质上没有确立沉默权。

This paper analyzes the Article 50 and Article 118 of the current criminal procedure law to demonstrate that there is no implied right to silence or expressive right to silence and that there is no trial right to silence or interrogation right to silence either . Although the right to silence in Chinese criminal procedure law is hidden and revealed , in fact there is no establishment of right to silence in our criminal procedure law .
