随着刑事被害人权利保护呼声的日益高涨，被害人的诉讼地位越来越受到重视。加强被害人的权利保障，并对被害人与被告人的权利进行平衡，已经是各国刑事诉讼法的发展趋势。我国刑事诉讼法确立了被害人的当事人地位，赋予其广泛的诉讼权利，但在被害人权益保护方面仍存在一些不足，我国应充分赋予刑事被害人诉讼参与权和意见陈述权，建立完备的国家援助及国家补偿制度，从而恢复因犯罪而遭受破坏的法秩序，缓和社会的报应情感，促进民众对刑事司法的信心。

With the rising appeal of the criminal victims' rights protection, the status of the victim arouses more attention. Strengthening the protection of the victims’ rights and balancing between the rights of the victim and the accused have become a common trend of various countries’ criminal law. Chinese Criminal Procedure Law establishes the status of the victim's party, giving the victim extensive rights litigation. But there are still some deficiencies in the area of the protection of rights and interests of victims. The Criminal Procedure Law of China should further strengthen the victims' right to participate in lawsuit and state the opinions; establish the comprehensive system of the state aid and compensation system. The victim will receive adequate relief and compensation in criminal proceedings.
