合作国家所内含的指导理念即是改变传统行政管制模式下政府与私人间的对抗关系，通过合作解决市场失灵和政府失灵的管制困境，即以合作理念作为国家治理新的规范性理念。按照合作国家的要求，行政将更多地采用公私合作治理的方式进行。规范行政的行政法也就需要有所应对，为实现合作国家建构规范公私合作的法律制度。这主要包括保障合作关系建立的行政法制度，以及规制公私合作的行政法制度。这些制度拓展了行政法的疆域，属于合作行政法的范畴。

T he guiding idea embedded in the cooperative state is to change the adversarial relationship between the government and the individuals in the traditional mode of administration and to come out of the plight of the market failure and the government failure ,i .e .the cooperative idea is taken as the normative philosophy of the state governance . According to the requirement of the cooperative state ,more administration will be done in the way of cooperative management by the public and the private together , thus the administrative law , w hich regulates administration , need change accordingly .The legal system must be constructed to regulate the public and private cooperation for the cooperative state ,including the administrative law systems of ensuring the cooperative relationship and regulating the public and private cooperation ,w hich expands the range of the administrative law and can be referred as cooperative administrative law .
