饱受诟病的劳动教养制度已经成为历史。但当劳动教养制度被废止后，就原来劳动教养对象的管控方面，在“一元化”刑法惩罚制度之内寻求通过刑法分流部分劳动教养对象的做法，是不适宜的，不值得提倡。原劳动教养的部分对象可通过“二元化”刑法惩罚制度来分流，要实现非犯罪化的保安处分，避免犯罪标签化带来的负面影响；同时要将保安处分范畴的劳动教养事由，纳入司法审查的范围和程序。保安处分范畴外的其他原劳动教养对象，则宜通过治安管理处罚和非违法化来实现类型化分流和处置。

The notorious “Reeducation through Labor Institution” will soon become history .But when it is abolished ,in the “unified” criminal penalty system ,the disadvantage of the think of diffluence some reeducation‐through‐labor object by criminal law is not proper ,so it is not worth advocating .Some reeducation‐through‐labor object can be managed by “dualistic” criminal penalty system .Security measures of decriminalization should be realized to avoid the negative influence of crime labeling .Meanwhile ,the reasons of reeducation through labor of security measures category should be brought into the range and procedure of judicial review .The other categorized diffluence and treatment should be realized through public security punishment and non‐illegality .
