汉冶萍公司是近代中国洋务运动的产物，曾被誉为亚洲第一雄厂，代表着一代精英实业救国的梦想。但时值国家民智未开，国民严重缺乏理性的财产权观念，再加上其深处封建生产关系的泥沼，本身又得不到来自宪法授权的国家权力的强有力保护，因而在历次对外贸易中饱受日本帝国主义势力的盘剥与压榨，继而走向衰亡。用法律的理性思维来检视汉冶萍公司的兴衰过程，可折射出一幅近代中国身处逆境仍挣扎图强的图景，同时也为今天中国的法治建设提供了若干启示。
漢冶萍公司是近代中國洋務運動的產物，曾被譽為亞洲第一雄廠，代錶著一代精英實業救國的夢想。但時值國傢民智未開，國民嚴重缺乏理性的財產權觀唸，再加上其深處封建生產關繫的泥沼，本身又得不到來自憲法授權的國傢權力的彊有力保護，因而在歷次對外貿易中飽受日本帝國主義勢力的盤剝與壓榨，繼而走嚮衰亡。用法律的理性思維來檢視漢冶萍公司的興衰過程，可摺射齣一幅近代中國身處逆境仍掙扎圖彊的圖景，同時也為今天中國的法治建設提供瞭若榦啟示。
한야평공사시근대중국양무운동적산물，증피예위아주제일웅엄，대표착일대정영실업구국적몽상。단시치국가민지미개，국민엄중결핍이성적재산권관념，재가상기심처봉건생산관계적니소，본신우득불도래자헌법수권적국가권력적강유력보호，인이재력차대외무역중포수일본제국주의세력적반박여압자，계이주향쇠망。용법률적이성사유래검시한야평공사적흥쇠과정，가절사출일폭근대중국신처역경잉쟁찰도강적도경，동시야위금천중국적법치건설제공료약간계시。
The Hanyeping Company is the product of Westernization Movement in modern China , once hailed as the first largest enterprise, which represents the elite generations'dream of saving the nation by engaging in industry .But as the wisdom of the people was not enlightened , with severe lack of rational awareness of proper-ty right and being struck in the productive relations of feudalism , the nation was not protected by state power authorized by the constitution .Accordingly, the Hanyeping Company had been exploited by Japanese imperial-ism forces during the process of international trade and collapsed finally .The analysis of the rise and fall of the HanyePing Company in terms of law will reflect a picture of recent China in adversity struggling to be stronger;its conclusion will provide some implications for the Law construction in China today .
