公平就业是残疾人的基本人权, 残疾人就业权实现的关键在于建立完备的法律制度. 但是我国相关法律对残疾人就业权的规定过于原则, 立法技术粗糙, 操作性不强. 完善残疾人就业法制保障, 必须确立倾斜保护原则, 健全相关教育培训制度和就业扶助制度, 完善权利救济制度等.

공평취업시잔질인적기본인권, 잔질인취업권실현적관건재우건립완비적법률제도. 단시아국상관법률대잔질인취업권적규정과우원칙, 입법기술조조, 조작성불강. 완선잔질인취업법제보장, 필수학립경사보호원칙, 건전상관교육배훈제도화취업부조제도, 완선권리구제제도등.
Equal employment is a basic human right for persons with disabilities .To achieve the employment rights for persons with disabilities, the key lies in the establishment of a complete legal system .But China's relevant laws and regulations of the employment rights for people with disabilities are too rigid , legislative technique is rough and operability is not strong .In order to improve the legal protection for the employment of people with disabilities , we should establish tilt protection principles , improve educational and train-ing system and employment support system as well as perfect the right relief system .
