科技时代与信息时代交相融合，体育器材在提高体育健身保障中的作用非常明显，相关体育专业人员研究制造了大量运动器材。对于保障相关体育器材发明人的知识产权和独占性，相关的立法保护已通过国家和国际认同，相对成熟的知识产权和认证系统对促进体育科技创新发展提供了良好的法律保障。通过对知识产权、体育知识产权的解释，分析目前我国的体育运动器材市场的现状，其中存在的问题，据此提出体育运动器材专利的相关发展对策。

with the development of science and technology and the information , it is an obvious effect that promote the development of sports in all aspects, sports equipment play important role in improving physical fitness safeguard, and relevant researchers have made a lot of sports professional sports equipment. In order to protecting the intellectual property rights of sports equipment ,relevant legal protection has been through the national and international recognition, which have relatively mature intellectual property rights and certification system to promote the development of sports science and technology innovation ,it provides a good legal protection. Through the interpretation of the intellectual property rights to intellectual property rights of sports, the present status of the sports equipment market in China, the article analyses the existing problems and related development countermeasures on the basis of sports equipment patent.
